TERMS AND CONDITIONS OF SALE

Please carefully read our terms of sale before placing your order and keep a copy of these terms for future reference.

1. Seller Identification

This website is operated by Poliopticas Lda, corporate entity nº 507984196, with registered office at Av. da Boavista, Ed. Príncipe do Minho, Loja 136, Monção. For any questions, you may contact us via email at poliopticaslda@gmail.com or by telephone at +351 251656195 on business days from 09:00 to 19:00 and Saturdays from 09:00 to 13:00. Poliopticas Lda is hereinafter referred to as “Poliopticas” or “we/us/our”, and the buyer/user is referred to as the “Customer”.

2. Scope and Acceptance of Terms

These Terms and Conditions govern the purchase and sale of products made available by Poliopticas to end consumers, both in the online store www.poliopticas.com and in physical stores. By placing an order or creating an account on our website, the Customer declares that they have read, understood and accepted these Terms and Conditions, as well as our Privacy and Cookies Policy. These Terms prevail over any Customer conditions unless expressly agreed otherwise in writing by Poliopticas. Poliopticas may update these Terms at any time; therefore, we recommend periodically consulting this page. The last update date appears at the top of the document.

3. Product Features, Safety and Pre-Contractual Information

Poliopticas sells glasses (frames, prescription lenses, sunglasses), contact lenses, optical products and related items. Essential product characteristics (materials, colours, sizes, available dioptres, etc.) are indicated on each product page. For personalised products (e.g., prescription-based lenses), this will be clearly stated. We strive to ensure descriptions, photos and information are accurate and up to date; however, typographical errors or unintentional inaccuracies may occur. Such situations will be corrected as soon as identified, without prejudice to the Customer’s rights.

Product Safety and Compliance (EU Regulation 2023/988 – General Product Safety): Poliopticas markets products compliant with applicable safety rules. Where applicable, products include identification of the manufacturer, importer or responsible economic operator established in the European Union, as well as safety instructions in Portuguese. Poliopticas maintains traceability procedures (where applicable) allowing identification of origin and/or product batches and enabling corrective actions if a risk to consumer health or safety is detected.

All prices shown on the website include VAT at the applicable legal rate (unless expressly stated otherwise) and are indicated in euros. Any additional costs (e.g., shipping or customs duties for international shipments) will be clearly presented before purchase completion. Poliopticas reserves the right to change prices at any time; however, the price charged will be the one in force at the time of the order (except in case of obvious publishing errors). In case of a manifest price error, the Customer will be contacted and may cancel the order free of charge or confirm it at the correct price.

4. Orders

Customers may place orders through the following channels:

Online: via www.poliopticas.com. Customers may register an account or purchase as a guest. They must provide personal data necessary to process the order. After submission, a confirmation email acknowledging receipt will be sent. This acknowledgement does not constitute final acceptance of the order. Poliopticas reserves the right to refuse orders in legitimate cases such as product unavailability, suspected fraud or breach of these Terms. The sales contract is considered concluded when we send confirmation of shipment or availability for collection.

By Email: Customers may place orders via poliopticaslda@gmail.com. Orders will only be processed after explicit confirmation and payment (when applicable).

In Physical Store: Orders may be placed directly in Poliopticas stores (Monção and Melgaço). Purchases in store follow the legislation applicable to in-person sales; the legal 14-day withdrawal right does not apply to in-store purchases.

5. Payment

Available payment methods include cash or debit card in store, Multibanco reference, MB Way and credit/debit cards (Visa/Mastercard). Transactions are encrypted and may be subject to security verification.

6. Delivery and Transport

Deliveries are available in mainland Portugal, autonomous regions and internationally. Estimated delivery times:

  • Mainland Portugal: 3–5 working days

  • Islands: 5–10 working days

  • EU: 5–8 working days

  • Outside EU: approx. 7–15 working days (customs dependent)

7. Order Complaints

Customers must notify Poliopticas within 15 days if the product is incorrect or visibly damaged.

8. Order Cancellation

Customers may cancel orders before dispatch free of charge. Poliopticas may cancel orders in exceptional cases such as stock issues, suspected fraud or pricing errors.

9. Right of Withdrawal (Online Purchases)

Customers have 14 days to withdraw from distance contracts without providing a reason, except for personalised prescription products.

10. Returns and Exchanges (Physical Store)

There is no legal obligation to accept returns for change of mind on in-store purchases, although Poliopticas may allow exchanges on a goodwill basis.

11. Legal Guarantee and After-Sales Support

All products benefit from a 3-year legal conformity guarantee under Portuguese law.

12. Exchange Policy

Exchanges may be allowed commercially but are not a legal right unless under withdrawal rights or lack of conformity.

13. Website Use and User Conduct

Users must act in good faith and not misuse the website or attempt fraudulent activities.

14. Personal Data Protection

Personal data is processed in accordance with GDPR and applicable legislation.

15. Cookies Policy

The website uses necessary and analytical cookies (when consented).

16. Alternative Dispute Resolution

Consumers may resort to Alternative Dispute Resolution entities or the European ODR platform.

17. Applicable Law

Portuguese law applies. The competent court is the consumer’s domicile.

18. Final Provisions

Invalidity of any clause does not affect the remaining provisions.
